Ik vond dit interessante discussies; niet alleen omdat mijn bedrijf <a href=\"http:\/\/www.biobased-opportunities.com\/abstraction\/Blog\/Blog.html\" target=\"_blank\">Abstraction<\/a> samen met <a href=\"http:\/\/www.arn.nl\/\" target=\"_blank\">ARN<\/a> een methode levert om bijproducten te registreren, maar ook omdat het bedrijfsleven tot mijn verbazing nog steeds lijkt te denken dat overheidsregels het gebruik van afval in de weg staan. Terwijl in de afgelopen tien jaar door verbetering van de Europese afvalwetgeving de mogelijkheden voor nuttig gebruik van bijproducten juist zijn toegenomen.<\/strong><\/p>\n<figure id=\"attachment_8095\" aria-describedby=\"caption-attachment-8095\" style=\"width: 288px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-8095\" src=\"https:\/\/www.biobasedpress.eu\/wp-content\/uploads\/2015\/11\/Neste-Rotterdam.jpg\" alt=\"Neste Rotterdam\" width=\"298\" height=\"217\" \/><figcaption id=\"caption-attachment-8095\" class=\"wp-caption-text\">Neste scheidt in zijn raffinaderij in Rotterdam uit restgas groen propaan af, dat niet als afval wordt geclassificeerd. Foto: Neste &amp; Hugo de Wolf.<\/figcaption><\/figure>\n<p>Milieuwetgeving en economische wetgeving hebben verschillende doelstellingen, en  benaderen materialen daardoor op hun eigen manier. Ze mogen daarom niet worden vergeleken. In economische termen worden de vele materialen die in industri\u00eble en agrarische processen worden voortgebracht bijproducten genoemd, of co-producten, tussenproducten, niet-kernproducten of subproducten. Maar geen van deze termen heeft enige betekenis in de milieuwetgeving binnen de Europese Unie; producten en bijproducten hebben dezelfde status: materialen zijn simpelweg afval, of niet.<\/p>\n<h2>Europese afvalwetgeving ontwikkelt zich<\/h2>\n<p>De jurisprudentie van de laatste jaren geeft echter duidelijkere antwoorden op de vraag of een materiaal moet worden beschouwd als afval of niet. Restmaterialen van productieprocessen zijn niet per se afval, volgens uitspraken van het Europese Hooggerechtshof. Het hof heeft hiervoor een aantal regels opgesteld. Zo oordeelt het hof dat, als de productie van het betreffende materiaal \u2018het gevolg was van een bewuste keuze\u2019 (om uitdrukkelijk dit materiaal te maken), het geen restmateriaal is, of afval. Dat geldt ook als het materiaal zonder meer kan worden gebruikt in vervolgprocessen. En het kan evenmin worden beschouwd als afval als verder gebruik van het materiaal niet alleen mogelijk, maar ook zeker, is. Ook \u2018afval\u2019 waarvan kan worden aangetoond dat het nuttig toegepast kan worden, kan zijn afvalstatus verliezen als het beschikbaar is om als gerecycled product te worden ingezet.<\/p>\n<figure id=\"attachment_8097\" aria-describedby=\"caption-attachment-8097\" style=\"width: 288px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-8097\" src=\"https:\/\/www.biobasedpress.eu\/wp-content\/uploads\/2015\/11\/Demolition-waste.jpg\" alt=\"Sloopafval\" width=\"298\" height=\"224\" \/><figcaption id=\"caption-attachment-8097\" class=\"wp-caption-text\">Sloopafval wordt niet als afval geclassificeerd als het op de juiste manier wordt behandeld.<\/figcaption><\/figure>\n<p>Een recent voorbeeld van de toepassing van Europese afvalwetgeving betreft de productie door Neste van <a href=\"https:\/\/www.neste.com\/nl\/nl\/voor-klanten\/hierneuwbare-producten\/NEXBTL-hernieuwbaar-propaan-een-schone-brandstof-wordt-nu-nog-schoner\" target=\"_blank\">propaan uit groene grondstoffen<\/a> in een nieuwe installatie in hun Rotterdamse raffinaderij. Deze installatie zal uit restgas van de raffinaderij propaan scheiden en zuiveren, zodat het zonder verdere opwerking conventioneel propaan kan vervangen. Ook het op basis van technische, milieukundige en systeemoverwegingen opheffen van de \u2018afval\u2019-status van <a href=\"https:\/\/zoek.officielebekendmakingen.nl\/stcrt-2015-3498.html\" target=\"_blank\">bouw- en sloopafval granulaat<\/a> kan in dit kader worden genoemd. Het granulaat wordt onder meer gebruikt door bouwmaatschappijen en cementfabrieken.<\/p>\n<h2>Niet meer klagen<\/h2>\n<p>Afval omvormen tot een product is bij de bestaande wetgeving een prima optie, maar men moet dan wel goed op de hoogte zijn van de van toepassing zijnde jurisprudentie. Het herhalen van de mantra dat de Europese afvalwetgeving ontwikkelingen in de weg staat is al te gemakkelijk. Je moet de regels van het spel beter kennen en deze gaan toepassen. En je zult het misschien hard moeten spelen indien verantwoordelijke autoriteiten niet mee willen doen. Ja, dat kost tijd en moeite. En in de meeste gevallen zal je in je eentje niet succesvol kunnen zijn, en zal samenwerking met anderen met hetzelfde probleem noodzakelijk blijken.
