Biotechnologen moeten daarom de relatie tussen openbare en patenteerbare kennis opnieuw doordenken \u2013 net als bij computersoftware.<\/strong><\/p>\n<figure id=\"attachment_4486\" aria-describedby=\"caption-attachment-4486\" style=\"width: 192px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-4486\" alt=\"DNA\" src=\"https:\/\/www.biobasedpress.eu\/wp-content\/uploads\/2013\/09\/DNA1.png\" width=\"202\" height=\"397\" \/><figcaption id=\"caption-attachment-4486\" class=\"wp-caption-text\">DNA-volgordes on de natuur kunnen niet worden gepatenteerd, aldus het Amerikaanse Hooggerechtshof<\/figcaption><\/figure>\n<p>Lux Research, een bedrijf uit Boston, publiceerde vorige maand een rapport\u00a0 \u2018BioPunks and BioPatents: The Open-source Battle Comes to Synbio IP\u2019 dat deze relatie tussen openbare en patenteerbare kennis in de biotechnologie onderzoekt, en de invloed van de beslissing van het Hooggerechtshof daarop. De uitspraak heeft vooral betrekking op de synthetische biologie, een terrein dat snel aan belang wint binnen de biotechnologie. Kort gezegd omvat synthetische biologie het ontwerp en de bouw van biologische eenheden en systemen voor nuttige doeleinden. Synthetische biologie probeert te ontdekken hoe het leven werkt, en maakt op basis van die kennis waardevolle producten of diensten door delen van dat mechanisme te veranderen.<\/p>\n<p><strong>Patenten als dure obstakels voor innovatie<\/strong><br \/>\nHet Amerikaanse biotechnologische bedrijf Myriad ontdekte twee genen die grotendeels het voorkomen van borstkanker bepalen. Het probeerde deze kennis als zodanig te patenteren, d.w.z. het wilde recht doen gelden op het exclusieve gebruik van deze kennis. Maar het Hooggerechtshof oordeelde dat de natuur zelf niet patenteerbaar is. Volgens Lux Research maakt deze uitspraak een eind aan een lang bestaand systeem van octrooirecht; en als gevolg daarvan zullen biotechnologische bedrijven opnieuw moeten doordenken hoe ze openbare kennis gaan gebruiken in hun innovatieplannen, willen ze slagen in dit veld in ontwikkeling. Lux tekent op dat velen de oude patenten zien als wettelijk twijfelachtig, en als dure obstakels voor innovatie.<\/p>\n<p>Lux meent dat bedrijven en consumenten voordeel zullen hebben van de vergrote ruimte van openbare biologische kennis. Het ziet een parallel in open-source computercodes: standaardprotocollen als GSM en HTML, en modulaire software. Deze hebben de informatietechnologie veranderd en productinnovatie aangejaagd. Stel daar tegenover, zo zegt het bedrijf, de miljarden kostende patentenstrijd die innoverende bedrijven als Google, Apple en Samsung steeds verder in een moeras trekt. Goed toegepaste openbare kennis heeft vele voordelen. Openbaar bekende genetische codes, zoals modulaire DNA-volgordes, kunnen de ontwikkeling van betere medicijnen, biobased materialen en nuttige organismen versnellen, zegt Lux.<\/p>\n<p><strong>Samenwerking in de keten<\/strong><br \/>\n\u2018Maar de open-source biologiebeweging moeten we niet zien als een alternatief voor traditionele R&amp;D of als vijand van IP,\u2019 zegt Mark B\u00fcnger, onderzoeksdirecteur van Lux en eerste auteur van het rapport. \u2018Bedrijven zouden eigenlijk samenwerking in de keten moeten nastreven, met een mix aan partners in bedrijven en aan universiteiten, waarbij de open-source gemeenschap belangrijk is in de eerste fasen van het onderzoek.\u2019<\/p>\n<p>Om de toekomstige verhoudingen tussen patenteerbare en openbare kennis te onderzoeken bestudeerden analisten van Lux Research meer dan 10.000 patenten in 14 sleutelgebieden van de synthetische biologie. Zij ontdekten dat het aanvragen van octrooien nog altijd gebruikelijk is bij het modificeren van organismen ten behoeve van de productie van chemicali\u00ebn en brandstoffen. Als de \u2018next frontier\u2019 zien zij nieuwe materialen, zoals materialen op basis van eiwitten gelijkend op spinrag. Hier is de kennis vaak nog openbaar, maar bedrijven vragen ook al patenten aan.
